Terms of Service

Welcome to Prizio. These Terms of Service ("Terms") establish the conditions under which you may use our mobile app for comparing supermarket prices in Honduras.

1. Acceptance of Terms

By registering, accessing, or using Prizio, you declare that:

• You have read and understood these Terms of Service.
• You are at least 13 years of age.
• You have the legal capacity to accept these Terms.
• You agree to comply with all provisions established herein.

If you use Prizio on behalf of an organization, you declare that you have authority to bind that organization to these Terms.

2. Service Description

Prizio is a mobile app that allows users to:

• Compare product prices in Honduran supermarkets.
• Search products by name or barcode.
• Save favorites for price tracking.
• Create personal and shared shopping lists.
• Receive price change notifications (Premium users).
• View historical price trends.

2.1 Available Stores

Currently, Prizio obtains prices from the following supermarket chains in Honduras:

• La Colonia
• Walmart Honduras
• Paiz
• Diprova
• PriceSmart

Store availability may vary without prior notice.

3. Account Types

Prizio offers two types of accounts with different features:

3.3 Bonus System

Free account users can get additional searches, scans, or queries by watching rewarded ads. Bonuses are subject to weekly limits (maximum 3 per week per type).

4. Subscriptions and Payments

4.1 Payment Process

Premium subscriptions are processed through:

• App Store (Apple): For iOS devices.
• Google Play Store: For Android devices.

Prizio does not have access to your complete payment information. All payments are managed directly by Apple or Google.

4.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period, unless you cancel at least 24 hours before the renewal date.

4.3 Cancellation

You can cancel your subscription at any time through:

• iOS: Settings > [Your name] > Subscriptions > Prizio.
• Android: Google Play Store > Menu > Subscriptions > Prizio.

Cancellation will be effective at the end of the current billing period.

4.4 Refunds

Refund policies are determined by Apple and Google respectively. To request a refund, you must contact the store where you made the purchase directly.

5. User Conduct

By using Prizio, you agree to:

5.1 Permitted Use

• Use the app only for personal, non-commercial use.
• Provide truthful information when creating your account.
• Maintain the confidentiality of your access credentials.
• Respect the rights of other users in shared lists.

5.2 Prohibited Use

It is strictly prohibited to:

• Scraping or automated extraction: Use bots, scripts, or tools to extract data from the app.
• Reverse engineering: Decompile, disassemble, or attempt to obtain the source code.
• Fraudulent use: Create multiple accounts, manipulate statistics, or evade limits.
• Spam or abuse: Send unwanted content or abuse shared list features.
• Share credentials: Share your account with third parties.
• Unauthorized commercial use: Resell, redistribute, or use information for commercial purposes.
• Interference: Attempt to overload, hack, or interfere with servers.

6. Information Accuracy

6.1 Price Source

Prices shown in Prizio are obtained through automated access to publicly available web pages of the included supermarkets, using responsible data collection practices. We make our best effort to keep information up to date, but we cannot guarantee:

• That prices are accurate at all times.
• That products are available at all locations.
• That offers or promotions apply at all locations.

6.1.1 Data Sources

Prices shown in Prizio are obtained through:

• Automated access to publicly available supermarket web pages.
• Information available without authentication or registration.
• Public APIs provided by stores when available.

Prizio has no commercial relationship, affiliation, or formal agreement with the included stores. Prices are collected independently using responsible data collection practices, for the benefit of Honduran consumers.

6.2 Price Variations

Prices may vary due to:

• Local or regional promotions.
• Price changes made after our last update.
• Differences between branches of the same chain.
• Errors in the original supermarket sources.

6.3 Third-Party Data

Price information belongs to its respective owners. Prizio acts as an aggregator of public information for the benefit of consumers, protected by fair use principles for price comparison and promotion of healthy market competition.

We have no commercial relationship or affiliation with the included stores. Inclusion of a store in Prizio does not imply endorsement or commercial association.

7. Intellectual Property

7.1 Prizio Property

The Prizio app, including its design, code, logos, graphics, and interfaces, is owned by its developers and protected by intellectual property laws.

7.2 Third-Party Content

Prices, images, and product descriptions belong to their respective supermarkets and manufacturers. Prizio does not claim ownership of this content.

7.3 User Content

You retain ownership of any content you create within the app, including:

• Names and notes in your shopping lists.
• Customized settings.

By using Prizio, you grant us a limited license to store and display your content for the purpose of providing the service.

8. Limitation of Liability

8.1 Disclaimer of Warranties

We do not warrant that:

• The service will be uninterrupted or error-free.
• Prices shown are accurate or current.
• The app is compatible with all devices.
• Results obtained are accurate or reliable.

8.2 Limitation of Damages

We will not be liable for:

• Purchasing decisions based on app information.
• Differences between displayed price and actual store price.
• Economic losses resulting from app use.
• Service interruptions or data loss.
• Indirect, incidental, or consequential damages.

8.3 Maximum Limit

In any case, our total liability will not exceed the amount you have paid for Premium subscription in the last 12 months, or L. 500.00 (five hundred lempiras), whichever is less.

9. Shared Lists

9.1 Roles and Permissions

• Owner: Full control over the list, can invite, remove members, and change roles.
• Editor: Can add, modify, and delete list items.
• Reader: Can only view list content.

9.2 Invitations and Codes

• Email invitations have a limited expiration time.
• Sharing codes expire after a short period for security.
• Codes can only be used once.

9.3 Content Responsibility

The owner of a shared list is responsible for its content. Prizio does not actively monitor list content but reserves the right to remove content that violates these Terms.

10. Termination

10.1 By User

You can stop using Prizio at any time:

• Logging out of the app.
• Canceling your subscription (if applicable).
• Requesting account deletion via email.

10.2 By Prizio

We reserve the right to suspend or terminate your account if:

• You violate these Terms of Service.
• You use the app fraudulently or abusively.
• You don't pay for Premium services (after grace period).
• Required by law.

10.3 Effects of Termination

After termination of your account:

• You will lose access to the app and your data.
• Your data may be deleted after a reasonable period.
• You will not be entitled to a refund (except where required by law).
• Shared lists you own may be transferred or deleted.

11. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Republic of Honduras.

Any dispute related to these Terms or the use of Prizio will be subject to the exclusive jurisdiction of the competent courts of Honduras.

13. Modifications to Terms

We may modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date at the top of the document.
• For significant changes, we will notify you through the app or by email.
• Continued use of Prizio after changes constitutes your acceptance of the new Terms.

If you don't agree with the changes, you can stop using the app and request deletion of your account.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Prizio regarding the use of the app.

14.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

14.3 Waiver

Our failure to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restrictions.
